Defining Mediation and Arbitration

- Mediation offers a forum for both parties and their attorneys to share their concerns and work together to find a mutual resolution. The mediator is a neutral third party who facilitates the process and guides parties toward an agreement.
- Arbitration is similar to mediation with the process being managed by an arbitrator. After the parties, and/or their attorneys, present arguments, the arbitrator issues a binding decision to resolve the dispute.
