'The Court finds that Defendants counsel (Mr. Penichet) achieved remarkable results for Defendant in the period from the inception of the action until December 31, 2005. Defense counsel (Mr. Penichet) successfully defended the grounds trial and established Plaintiffs lack of credibility, succeeded in preventing the disappearance of the custodial accounts, obtained temporary exclusive use and occupancy and temporary custody, obtained a substantial pendente lite award, protected the children from potential alcohol abuse by Plaintiff, obtained an order requiring an evaluation of Plaintiffs assets, and obtained significant enforcement of all of the relevant court orders. The Court also finds that these results were obtained despite the substantial difficulties posed by the failure of Plaintiff and her family to cooperate. The results not only benefitted Defendant but were also of a substantial benefit to the children in terms of the preservation of their college funds.'
The Court awarded the Penichet Firm nearly one third of a million dollars in attorneys fees, to be paid by the other side, for this effort.
